Introduction
Welcome to HC Renovate’s Terms of Service (“Terms”). These Terms outline the terms and conditions that govern your use of and access to the websites, products, and features provided by HC Renovate, including its domains and web/mobile applications (collectively referred to as the “Services”). By using or accessing the Services, you agree to comply with these Terms, as well as our Copyright Policy, Privacy Statement, and Acceptable Use Policy (together forming this “Agreement”).
If you are using the Services on behalf of an organization, you deliver that you have the authority to agree to this Agreement on behalf of that organization. References to “you,” “your,” and similar terms are construed accordingly in this Agreement. If you do not agree to all the terms in this Agreement, you may not use or access the Services.
1.1. Account Creation
To utilize many of the Renovation Services, you must create an account (“Account”). By creating an Account, you agree to provide accurate, complete, and updated information. HC Renovate may use this information to contact you.
1.2. Account Security
Safeguard your account, ensuring that others do not have unauthorized access. You are responsible for any activity on your account and for maintaining the confidentiality and security of your password. Notify us immediately if you suspect unauthorized use or compromise of your account.
1.3. Age Requirement:
The Services are not intended for users under the age of 16. By using the Services, you confirm that you are at least 16 years old. If under 18, you may need parental or guardian consent.
1.4. HC Renovate Process
When inquiring about a renovation project, you are dealing with an individual, locally-owned, and operated business franchisee. HC Renovate is not responsible for services and agreements between you and an individual franchise/”Renovation Specialist.”
2.1. Ownership of User Content
User Content, including text, photos, images, audio, video, and other materials, remains yours. However, by providing User Content, you grant HC Renovate a license to use it for providing, improving, promoting, and protecting the Services.
2.2. License to HC Renovate
You grant HC Renovate a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly display, and distribute User Content.
2.3. Featuring Your Content HC Renovate may feature Your Content for marketing and promotional activities. You grant HC Renovate the right to use any version of Your Content for such purposes. You can opt-out by contacting us at [contact email].
3.1. Ownership and Permissions:
You represent and warrant that you own all rights to your User Content or have legal rights and permissions to use it. Your User Content must not infringe on the rights of any third party.
3.2. Legal Compliance
Your use of the Services must comply with applicable laws, including export/import controls, regulations, and sanctions.
3.3. Acceptable Use Policy
You must comply with HC Renovate’s Acceptable Use Policy. All User Content should adhere to this policy.
3.4. Responsibility for End Users
If applicable, Your account may have its visitors, customers, and users (“End Users”). You are solely responsible for compliance with laws and regulations related to Your Account and your End Users.
4.1. Third-Party Services
The Services may integrate with third-party services and applications (“Third Party Services”). Their terms govern your use of Third Party Services, and HC Renovate is not responsible for them.
4.2.Third-Party Sites
The Services may contain links to third-party sites. Your access to third-party sites is at your own risk, and HC Renovate is not liable for those sites or third-party actions.
4.3.User Content
HC Renovate is not responsible for offensive or objectionable User Content. Users are advised to take precautions when accessing User Content via the Services.
5.1. Operational Rights
HC Renovate reserves the right to change, suspend, discontinue, or terminate parts or all of the Services, modify these terms, and alter eligibility criteria at any time and without notice.
6.1. Privacy Policy
By using the Services, you confirm your understanding of the Privacy Policy. The Privacy Policy is not part of this Agreement but is available for reference.
6.2. Compliance with Laws:
You agree to comply with data protection, security, and privacy laws when using Your Account or the Services.
6.3. Analysis of Services HC Renovate may analyze usage for the protection and improvement of Services, as detailed in the Privacy Policy.
This Agreement remains in effect until terminated by either party. HC Renovate reserves the right to change, suspend, or terminate the Services at its sole discretion, with reasonable notice upon suspension or termination. Provisions like Your Content, Our Intellectual Property, Warranty Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and Additional Terms survive termination.
8.1. Disclaimers
HC Renovate provides the Services “as is” and makes no warranties, express or implied, about the Services. The Services are provided with reasonable care, but HC Renovate disclaims any warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.2. Exceptions
To the extent permitted by law, disclaimers apply, and statutory rights remain unaffected.
9.1. General Limitation Except for EU
Consumers, HC Renovate and its affiliates, directors, officers, employees, and agents are not liable for indirect, special, incidental, exemplary, punitive, or consequential damages arising from the Services or this Agreement.
9.2. Maximum Liability
HC Renovate’s aggregate liability for all claims is limited to the greater of twenty dollars ($20) or ten pounds (£10) unless prohibited by applicable law. For EU Consumers, liability for intent and gross negligence is acknowledged, but HC Renovate is not liable for losses not reasonably foreseeable.
You agree to indemnify and hold harmless HC Renovate, its affiliates, and their directors, officers, employees, and agents from all claims, losses, liabilities, costs, and expenses arising from your breach of this Agreement, User Content, or violation of laws or third-party rights.
11.1. Applicability
This section applies to US Users and non-US users bringing claims against HC Renovate in the US.
11.2. Informal Resolution
Before filing a claim, agree to resolve disputes informally by contacting [contact email]. If unresolved within 30 days, a formal proceeding may be initiated.
By using HC Renovate’s Services, you acknowledge and agree to these Terms of Service.
